Article 1: General definitions and application
13PL means Penal Law, VTL means Vehicle and Traffic Law and FGL means Fish and Game Law. For example, PL 100.01 identifies Article 100, section 01.
-
Application and fair notice
An offense requires proof of the conduct and mental state stated in its definition. Restrictions dependent on licenses, inventory categories, prohibited items, unit conversions or special zones must be adopted and published before enforcement.
-
Mental states
Intentionally means acting with the conscious objective to perform the conduct or cause the result. Knowingly means awareness of the relevant facts. Recklessly means consciously disregarding a substantial and unjustifiable risk. Criminal negligence means failing to perceive such a risk in a gross departure from reasonable care. Ordinary carelessness alone is insufficient.
-
Physical injury
Physical injury means impairment of physical condition or substantial pain. Serious physical injury means injury creating a substantial risk of death, serious prolonged disfigurement, prolonged impairment of health or prolonged loss of bodily function. Medical findings and the circumstances may establish injury.
-
Death
Death must be confirmed under the server’s medical and character-death rules. Temporary incapacitation, a game death screen or revival alone does not automatically establish a completed homicide.
-
Weapons and instruments
A deadly weapon is a firearm, explosive weapon or other weapon designed to cause death or serious injury. A dangerous instrument is an item used in a manner readily capable of causing death or serious injury. Weapon Classes 1 through 4 must be defined in a published inventory schedule.
-
Possession
Possession means physical custody or knowing control with the ability and intent to exercise that control. Proximity, friendship, ownership of a shared property or being a passenger alone does not establish knowing possession.
-
Consent and authority
Consent must be voluntary and given by a person with authority and capacity to give it. Force, a credible threat or material deception defeats consent. Lawful authority includes an applicable rule, a valid court order or a recognized emergency power exercised within its limits.
-
Property and value
An owner is a person with a lawful interest superior to the accused person’s interest. Value means fair market value at the time of the act. Damage means reasonable repair cost, capped at replacement value. A disputed debt or good-faith ownership claim alone does not establish theft.
-
Official duties
An official-duty enhancement requires proof that the victim was performing lawful duties and that their role was known or reasonably apparent. Official status does not excuse unlawful conduct or supply missing elements.
-
Attempts
An attempt requires intent to commit the identified offense and a substantial step strongly confirming that intent. Mere planning is insufficient. Use the expressly listed attempt offense where one exists; this article creates no additional unlisted attempt penalty.
-
Overlapping charges
For the same act against the same victim or property, do not duplicate lesser and greater versions or synonymous offenses. Use one applicable assault or battery count for the same contact; one robbery type for the same taking; and one equivalent evidence-tampering, littering, corruption, vehicle-use or roadworthiness count for the same conduct. Distinct acts and victims require distinct proof.
-
Justification and protected conduct
Reasonably necessary force to stop an imminent unlawful attack may be justified; deadly force requires an imminent threat of death or serious injury. Authorized medical care and emergency rescue are excluded from offenses requiring unlawful conduct. Silence, seeking counsel, peaceful criticism, lawful recording and refusal of voluntary consent do not by themselves establish obstruction or resisting arrest.
-
Server conduct rules
This code does not authorize roleplay prohibited by server rules. Staff moderation remains separate from in-character criminal adjudication. No provision permits real-world harassment, discrimination or illegal conduct.
